4. SMS/Text Messaging
By providing your mobile phone number and opting into our SMS/text messaging service, you consent to receive text messages from Hauling Services related to your service requests, appointments, updates, and promotional offers.
Consent and Opt-In: You will be asked to explicitly consent to receive SMS messages before we send you any. This may be through a web form, a checkbox during sign-up, or by texting a keyword to a designated short code.
Message Frequency: Message frequency will vary depending on your interaction with our services.
Opt-Out: You may opt-out of receiving SMS messages at any time by replying "STOP" to any message you receive from us. You may also manage your communication preferences through your account settings (if applicable) or by contacting us at info@haulingservices.delivery. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time, and we will start sending SMS messages to you again.
Fees and Charges: Message and data rates may apply from your mobile carrier. Hauling Services is not responsible for any charges from your mobile carrier that may result from our SMS messages.
Support/Help: For help regarding SMS messaging, you can reply "HELP" to any message you receive or contact us at info@haulingservices.delivery.
No Guarantee: We do not guarantee the successful delivery of SMS messages, as delivery is subject to the effective transmission from your mobile carrier and other factors.
Eligibility: To receive SMS messages, you must be the owner or authorized user of the mobile phone number you provide and be authorized to incur any message or data charges.
5. Payment and Fees
All fees for services are clearly communicated and agreed upon before work begins or services are rendered. Payments must be made according to the terms set in our service agreements or invoices.
6. Limitation of Liability
Hauling Services is not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the website or services; (ii) any conduct or content of any third party on the website or services; (iii) any content obtained from the website or services; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose. All services are provided "as is" without warranties of any kind, either express or implied.
7. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the State of Alabama, without regard to its conflict of law principles. You agree to submit to the personal jurisdiction of the state and federal courts located in Alabama for any actions for which we retain the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of our copyrights, trademarks, trade secrets, patents, or other intellectual property or proprietary rights, as set forth in the Arbitration provision below, including any provisional relief required to prevent irreparable harm.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our website and services after those revisions become effective, you agree to be bound by the revised terms.
